The Service is web-based that allows You to register for an account on the Service to create and update an online website on 52 Rentals.com. Once registered with the Service, You will receive your own Web Site to post "Content". Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new 52 Rentals tools and resources, shall be subject to the Terms. In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. You also understand and agree that the service may include certain communications from 52 Rentals, such as service announcements, administrative messages and the 52 Rentals Newsletter, and that these communications are considered part of 52 Rentals membership and you will be able to opt out of receiving them. You agree not to access the Service by any means other than through the interfaces that are provided by 52 Rentals for use in accessing the Service.

In order to use the Service You must provide 52 Rentals with a valid email address and other registration information and be the owner of a registered domain name. You must have access to the domain name account in order to be able to change the Domain Name Servers (DNS) settings to point at your 52rentals website.

You will ensure that all usernames and passwords required to access the Website are kept secure and confidential. You will immediately notify 52 Rentals of any unauthorised use of your passwords or any other breach of security and 52 Rentals will reset your password.

When accessing and using the Website or Service You must:
a) not attempt to undermine the security or integrity of 52 Rentals computing systems or networks;
b) not use, or misuse, the Website in any way which may impair the functionality of the Website, or impair the ability of any other user to use the Website;
c) not attempt to gain unauthorised access to the computer system on which the Website is hosted or to any materials other than those to which you have been given express permission to access;
d) not transmit or input into the Website any files that may damage any other person’s computing devices or software; content that may be offensive; or material or Data in violation of any law (including Data or other material protected by copyright or trade secrets which you do not have the right to use).
e) not modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer the Website except as is strictly necessary to use for normal operation.
f) only access the Website manually. The use of automated agents, robots, or automated software, other than search engine spiders, to view the site is forbidden.
52 Rentals grants You the right to access and use the Website with the user roles according to your subscription type. This right is non-exclusive and non-transferable. You must only use the Website for your own lawful business purposes.

The Service or Website may provide, or third parties may provide, links to other websites or resources. Because 52 Rentals has no control over such sites and resources, you acknowledge and agree that 52 Rentals is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that 52 Rentals shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

52 Rentals does not claim ownership of the Content you place on your 52 Rentals web site. By submitting Content to 52 Rentals for inclusion on your 52 Rentals web site, you grant 52 Rentals a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your web site on 52 Rentals Internet properties. This license exists only for as long as you continue to be a 52 Rentals customer and shall be terminated at the time your Web site is terminated.
You acknowledge that 52 Rentals does not pre-screen Content, but 52 Rentals and its designees shall have the right to remove any Content that violates the Terms or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

You agree that you will not:
a) upload, post, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy (up to, but not excluding any address, email, phone number, or any other contact information without the written consent of the owner of such information), hateful, or racially, ethnically or otherwise objectionable;
b) harm minors in any way;
c) impersonate any person or entity, including, but not limited to, a 52 Rentals official or falsely state or otherwise misrepresent your affiliation with a person or entity;
d) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
e) upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
f) upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party;
g) upload, post, or transmit unsolicited commercial email or "spam". This includes unethical marketing, advertising, or any other practice that is in any way connected with "spam", such as (i) sending mass email to recipients who haven't requested email from you or with a fake return address, (ii) promoting a site with inappropriate links, titles, descriptions, or (iii) promoting your site by posting multiple submissions in public forums that are identical;
h) upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
i) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
j) stalk or otherwise harass another;
k) promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, without limitation, providing instructions on how to assemble bombs, grenades and other weapons or incendiary devices;
l) use the Service as a forwarding service to another website;
m) solicit passwords or personal identifying information for commercial or unlawful purposes from other users;
n) exceed the scope of the Service that you have signed up for; for example, accessing and using the features that you do not have a right to use, or deleting, adding to, or otherwise changing other peoples comments or content;
If any user is reported to be in violation with the letter or spirit of these terms, 52 Rentals retains the right to terminate such account at any time without further warning.

You understand and acknowledge that:
a) Your use of the Service is at your own risk.The provision of, access to, and use of, the Website is on an “as is" and ”as available" basis;
b) 52 Rentals will take all reasonable efforts to maintain the Service, but 52 Rentals is not responsible for any damage, loss of data, customer information, revenue or other harm to business arising out of delays, mis-delivery of information, restriction or loss of access, bugs and other errors, unauthorised use due to sharing of the access to the Service. You are responsible for maintaining and keeping a copy of your data and images that may reside on the Service;
c) 52 Rentals does not warrant that (i) the Service will meet your specific requirements or expectations, (ii) Service will be timely, error free, secure or uninterrupted and, (iii) any errors in the Service will be corrected.
d) Any material downloaded or obtained through the Service is done at your own discretion and risk and You will be solely responsible for any damage to you computer system or loss of data that may result.
e) No information or advice obtained through the Service shall create any warranty not stated in the Terms.
f) You warrant and represent that You are acquiring the right to access and use the Service and agreeing to these Terms for the purposes of a business and that, to the maximum extent permitted by law, any statutory consumer guarantees or legislation intended to protect non-business consumers in any jurisdiction does not apply to the supply of the Service or these Terms.

You acknowledge and agree that the Service contains proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge that 52rentals.com, 52rentals.co.uk, 52 Rentals and the 52 Rentals logo are trademarks of 52 Rentals. Except as authorised by 52 Rentals, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service, in whole or in part.
52 Rentals does not want to receive confidential or proprietary information from you through the Service or by email. Unless otherwise agreed in writing by 52 Rentals any material, information or idea you transmit to 52 Rentals by any means may be disseminated or used by 52 Rentals without compensation or liability to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products. However, this provision does not apply to your Content or to personal information that is subject to our Privacy Policy.

Subscriptions are offered on a calendar month basis, at varying costs depending on the features of the Service selected.
Subscriptions are for the period stated or any part thereof and commence immediately on receipt of payment.
Due to the digital nature of the subscriptions no automatic right of refund or cancellation exists after a subscription has been purchased by you in accordance with Regulation 13 of the Consumer Protection (Distance Selling) Regulations 2000.
Subscriptions can be cancelled at any time. When a subscription is cancelled no further payments will be taken by 52 Rentals. The Service will be terminated when the cancelled subscription expires. No unused part of a subscription will be refunded.
The Service does allow for upgrades/downgrades of features which take effect immediately upon receipt of the new subscription payment. No refund will be made on unused part of the previous subscription but the unused time will be added to any expiry date.

You agree to indemnify and hold 52 Rentals, and its subsidiaries, director’s, agents and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your Content, your use of the Service, your Guests activities, your connection to the Service, your violation of the Terms, or your violation of any rights of another, whether you are a registered user or not. The user is solely responsible for his or her actions when using the Service.

52 Rentals shall not be in default of any obligation under the Terms if the failure to perform the obligation is due to any event beyond 52 Rentals' control, including, without limitation, significant failure of a portion of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organised labour action, theft, destruction, terrorist activity, acts of God or other events of a magnitude or type for which precautions are not generally taken in the industry.

A person who is not a party to the Terms has no right to benefit under or to enforce any term of the Terms.

52 Rentals may assign its rights and obligations under the Terms and upon such assignment 52 Rentals shall be relieved of any further obligation under the Terms.

Unless the relevant party has the prior written consent of the other or unless required to do so by law each party will preserve the confidentiality of all confidential information of the other obtained in connection with the Terms. Neither party will, without the prior written consent of the other, disclose or make any confidential information available to any person, or use the same for its own benefit, other than as contemplated by the Terms.

Any failure or delay by 52 Rentals to enforce any of the Terms or to exercise any right under the Terms will not be construed as a waiver to any extent of our rights.

52 Rentals is entitled to restrict, suspend or terminate your subscription or deny You access to the Service or Website without notice in the event of a breach of the Terms.
52 Rentals shall be entitled to disclose your user identity and details if required or requested by the courts or other law enforcement authorities or in such other circumstances as 52 Rentals in its sole discretion considers reasonably necessary or appropriate.

Recognising the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content and you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.

A beta feature is part of the Website that 52 Rentals has developed and released for testing and feedback purposes. You understand and accept that there may be errors and inaccuracies with beta features inherent at this stage of development.

The Terms shall be governed by the laws of England and all claims concerning the Terms shall be brought exclusively in English courts located in England. The parties hereby consent to submit to the jurisdiction of such courts and waive any personal jurisdiction or venue defences concerning said forum. You are deemed to have agreed to the Terms when commencing use of the Service.
